The President of Armenia Armen Sarkissian applied to the Constitutional Court.

 Guided by Article 169, Part 1, Clause 4 of the Constitution, the President of the Republic submitted an application to the Constitutional Court requesting to determine the conformity of the law “On the military service and the status of the servicemen” of November 15, 2017, with the Constitution.

 

The full text of the following is below:

 

“The submission of the application is also due to the problems existing in the law-enforcement practices of the mentioned law, which became more obvious resulting from the Prime Minister’s initiative to dismiss the Chief of the General Staff of the Armed Forces of the Republic of Armenia Onik Gasparyan and the subsequent constitutional-legal processes.

The Constitutional Court has the opportunity, within the scope of its powers, to conduct a comprehensive, systemically interrelated examination and make a decision.

With the presented application, the decisions of the Constitutional Court and possible measures taken may have a most serious impact on the decisions adopted so far, on the current and further processes connected with the present situation, in the context of interpreting and applying the afore-said law.

 

The President of the Republic is hopeful that the relevant decision made as soon as possible will bring forth legal definiteness and contribute to the resolution of the current crisis”.
